Terms of Service

1. Acceptance of Terms

By accessing or using Picture Optimizer ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to the web application at optimizepicture.com, the WordPress plugin, and the REST API.

2. Service Description

Picture Optimizer is an image processing service that provides compression, format conversion, AI-powered metadata generation, and responsive image creation. The Service operates on a credit-based system where each processed image consumes credits from your account balance.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

4. Credit System and Billing

  • Credits are consumed when images are processed through the pipeline. Sample previews do not consume credits.
  • Subscription plans refill credits monthly on the billing cycle date. Unused credits do not roll over between billing cycles unless specified by your plan.
  • Credit pack purchases are one-time additions to your balance and do not expire.
  • Lifetime deal (LTD) credits refill monthly at the plan's specified rate for the lifetime of the Service.

5. Acceptable Use

You may use the Service to process images you own or have rights to process. You may not:

  • Upload illegal, harmful, or rights-infringing content.
  • Attempt to reverse-engineer, decompile, or extract the processing algorithms.
  • Use automated tools to abuse the API beyond your plan's rate limits.
  • Resell the Service as your own product without an Agency plan or written permission.
  • Attempt to circumvent the credit system or billing mechanisms.

6. Intellectual Property

You retain full ownership of your images. Picture Optimizer does not claim any rights to images you upload. We do not use your images for training, marketing, or any purpose other than processing your request.

The Picture Optimizer brand, logo, software, and documentation are our intellectual property and may not be copied or redistributed without permission.

7. AI-Generated Metadata

AI-generated alt text, titles, captions, descriptions, and filenames are provided as suggestions. While we strive for accuracy, AI output may contain errors. You are responsible for reviewing and editing AI-generated metadata before publication, especially for accessibility-critical content.

8. Service Availability

We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows are communicated in advance. Unscheduled downtime may occur. Credits are not refunded for temporary service interruptions lasting less than 24 hours.

9. Limitation of Liability

Picture Optimizer is provided "as is" without warranties of any kind. Our total liability to you for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

You may cancel your subscription and delete your account at any time. We may terminate accounts that violate these terms. Upon termination, your data is deleted within 30 days per our Privacy Policy.

11. Changes to Terms

We may modify these terms with 30 days notice via email. Continued use after the effective date constitutes acceptance. Material changes affecting pricing or credit policies will be communicated with 60 days notice.

12. Governing Law

These terms are governed by the laws of the State of Delaware, United States. Disputes will be resolved through binding arbitration.
